A man who spat at a shop customer after he was challenged for wearing his face mask wrongly has been jailed for 10 years.

Shane Wayne Michael pulled down his Covid face mask before spitting in his victim's face and shouting "If I have it, you have it."

Michael, 42, was at the Vision 4 Less eyewear shop in Iowa, US, on November 11 last year, the Iowa Capital Dispatch reports.

While there, he was said to be wearing his face mask pulled down slightly, leaving his nose exposed.

Another customer, Mark Dinning, asked Michael to fix his mask on properly, leading to the pair exchanging words before leaving and walking out to the car park.

It was then that the attack began, with both men falling to the ground and Michael jabbing his victim him in the eye, before he was bitten in return.

During the attack Michael kneed the man in the groin repeatedly before lowering his mask and spitting at him, as well as coughing on him.

Michael, however, was reported to have claimed that the other man started the fight after he 'shoulder-checked' him and poked him in the stomach on leaving the shop.

A witness, Bob Darr, told officers Michael seemed to be the aggressor, following his victim outside and then launching the attack.

A member of shop staff also said that Michael had been the aggressor, according to police.

He was later arrested and charged and after a trial he was said to have been convicted of wilful injury causing serious injury, which has a mandatory 10-year jail term.

He was sentenced on Wednesday to 10 years in prison for the attack while his lawyer has asked for a new trial because of video evidence that was not previously available.

Michael’s dad, Dennis Michael, was reported as saying his son felt he was acting in self-defence and had not committed a crime.

He said his son has asthma, “and so he’s not going to cover his nose and mouth because he can’t breathe. And there was no mask mandate in place. It was just a request by Vision 4 Less that people wear a mask, and he was.”

He claimed the sentence wasn't fair and added: “It’s like (Mr Dinning) got a black eye in a bar fight, and now my son is getting 10 years in prison."
